Waiver
I confirm that as a volunteer for Art & History Museums – Maitland, hereinafter A&H, that I understand and agree to the following:
General Provisions
1.A&H is committed to conducting activities and programs and holds the safety of volunteers in high regard. A&H continually strives to reduce such risks and asks that all volunteers follow safety rules and instructions that are designed to protect the volunteers’ safety.
2.A&H will only maintain such limited insurance coverage for volunteers that may be required by state and federal statutes if any. Therefore, A&H strongly urges all volunteers to review their personal health insurance policy for coverage.
3.I am sole responsible for determining if I am physically fit and/or properly skilled for any volunteer activity. It is advisable for all volunteers, especially those who are pregnant, disabled in any way, or recently suffered an illness, injury or impairment, to consult a physician before undertaking any physical activity.
4.I am not an employee of A&H and my participation in A&H activities will not lead to employment status, and I will not receive compensation for my volunteer services.
5.Although my volunteer activities may occur in A&H, my volunteer service will not lead to a paid position with A&H.
6.I must operate within the scope of the duties associated with my volunteer position whether performing those duties on or off A&H property.
7.I must abide by the policies, procedures, and general rules of A&H.
8.I must follow the directions and instructions of A&H professional staff responsible for supervising my activities.
9.I must be cooperative with other A&H paid and volunteer staff and work as a team member when necessary.
10.I must project a favorable and positive image to the public in my appearance, behavior and work habits.
11.I must be present and on time for all hours I have agreed to work.
12.I must responsibly care for and return all equipment.
13.I must read and fulfill the task descriptions for my volunteer position.
14.A&H may utilize my name or image or voice, or any combination thereof, to publicize A&H programs and activities. I waive and relinquish all claims against A&H for any compensation in regards to said promotions.
15.I understand that the A&H’s email system is intended for business use. Emails and anything else generated or stored on the A&H’s computers are the organization’s property. Anything I put or receive on the A&H’s voicemail is also the organization’s property. Personal correspondence should not be abused.
16.I understand that any material I produce for A&H will be considered a “work made for hire” under the copyright laws of the United States and that all such work will be the property of A&H. To the extent that any such work may not be considered a “work made for hire,” I hereby grant to A&H an unrestricted, perpetual right and license to use any such material for its general corporate purposes.
Warning of Risk
I recognize and acknowledge that despite careful and proper preparation, instruction, medical advice, conditioning and equipment, there is still a risk of serious injury when participating in any activity or program. I understand that no all hazards and dangers can be foreseen. I realize that volunteers must understand that depending on the activity, certain risks, dangers and injuries due to acts of God, inclement weather, slipping, falling, inadequate or defective equipment, failure in supervision or instruction, premises defects, horseplay, carelessness, lack of skill or technique, and all other circumstances inherent to activities and programs exist. In this regard, I recognize that it is impossible for A&H to guarantee absolute safety, and I agree to assume full risk of any and all injuries, damages or loss, regardless or severity, that I may sustain as a result of said participation.
Waiver and Release of All Claims and Assumption of Risk
I hereby waive, release, hold harmless and forever discharge A&H and its respective trustees, officers, employees, volunteers, agents, legal representatives and assigns, hereinafter collectively referred to as “Parties,” from any and all claims, actions, demands, and liability for any and all injuries, damages or loss, regardless of severity, that I may sustain as a result of said participation. I instruct my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate to waive, release, hold harmless and forever discharge the Parties from any and all claims, actions, demands, and liability for any and all injuries, damages or loss, regardless of severity, that I may sustain as a result of my volunteer service. I further agree to assume the full risk of any and all injuries, damages or loss, regardless of severity, that I may sustain as a result of my volunteer service.
